1. Acceptance

By creating an account, clicking “Get started”, or using any AlooChat™️ service (the “Service”), you agree to these Terms of Use (the “Terms”) and our Privacy Policy. If you do not agree, do not access the Service.

2. Changes to the Terms

We may update the Terms at any time. We will post the revised version and, for material changes, notify you by email or in-app banner at least 15 days before they take effect. Continued use after that date constitutes acceptance.

3. Eligibility & Account Security

You must be at least 18 and legally able to form contracts.

Keep credentials confidential; you are responsible for all activity under your account.

We may suspend or terminate accounts that violate these Terms or applicable law.

4. Subscription Plans & Payments

Pricing and entitlements are shown on the Pricing page.

All fees are billed in Kuwaiti Dinar (KD) plus VAT (where applicable).

Subscriptions renew automatically unless cancelled before the renewal date.

We pass through Stripe processing fees as a line-item called “Payment Processing.”

Except as required by law, payments are non-refundable.

5. Fair-Use & Acceptable-Use
You agree not to:

Misuse, probe, or overload our infrastructure;

Reverse-engineer or circumvent security;

Upload unlawful, infringing, or personal-data-heavy training sets without rights;

Use AlooChat to generate spam or disallowed content under OpenAI policy;

Breach export-control or sanctions regulations.

6. User Content & AI Training Data

You retain ownership of content you submit (“User Content”). By uploading it you grant us a worldwide, non-exclusive licence to (a) provide, secure and improve the Service, and (b) fine-tune language models solely for your workspace unless you opt into global training. Remove data at any time from AlooStudio™; model checkpoints will be retrained within 30 days.

7. Intellectual Property

All AlooChat code, trademarks, logos, and documentation are our property or that of our licensors. You receive a limited, revocable licence to use them only as part of the Service.

8. Third-Party Services & Integrations

Integrations (e.g., WhatsApp, HubSpot) are subject to their own terms. We are not liable for third-party outages or data handling.

9. Confidentiality

Each party will treat non-public information marked confidential—or that reasonably should be treated as such—with the same care as its own (minimum reasonable care) for five years after disclosure.

10. Privacy Reference

We process personal data in accordance with the GCC data-protection framework, including the UAE PDPL (2022), Saudi PDPL (2023), and Kuwait CITRA Regulation No. 26 of 2024. Details appear in our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES—EXPRESS OR IMPLIED—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

To the maximum extent allowed by law, our aggregate liability arising out of or related to the Service will not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You will indemnify and hold us harmless against third-party claims arising from (a) your misuse of the Service, (b) your User Content, or (c) breach of these Terms.

14. Suspension & Termination

We may suspend or terminate access immediately if required by law, to protect the Service, or upon material breach. On termination, your data will be deleted or de-identified within 90 days, except where retention is legally required.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kuwait. Any dispute will be finally settled by arbitration under the Kuwait Commercial Arbitration Centre Rules; seat Kuwait City; language English.

16. Compliance Statement

You agree that your use complies with all applicable sanctions, anti-money-laundering and data-protection regulations of the GCC, EU GDPR where applicable, and relevant U.S. export laws.

17. Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control (e.g., Internet outages, government action).
